Common interest developments: replacement and repairs.
Would provide that, unless otherwise provided in the declaration, the owner of each separate interest is responsible for repairing, and replacing the separate interest (basically the inside of a unit), and the association is responsible for repairing and replacing the exclusive use common area (e.g., patios, balconies, garages). Those responsibilities are undefined in current law. Resident groups argue that the bill results in unfair shifting of liability to homeowners, especially if the property is destroyed in a disaster.
